Segons la <a href=\"https:\/\/cpage.mpr.gob.es\/producto\/informe-anual-de-la-inspeccion-de-trabajo-y-seguridad-social-30\/\" target=\"_blank\" rel=\"noopener\">Mem\u00f2ria Anual de l&#8217;ITSS del 2023<\/a> , l&#8217;hostaleria concentra el <strong>19,64% del total d&#8217;infraccions detectades<\/strong> per Inspecci\u00f3 de Treball, davant de construcci\u00f3 (12,85%) i comer\u00e7 (10,30%). El 2024, les actuacions inspectores al sector van aflorar <strong>15.045 llocs de treball irregulars<\/strong> , la xifra m\u00e9s alta per sector.  <\/p><p class=\"font-claude-response-body break-words whitespace-normal leading-[1.7]\">Els motius s\u00f3n clars: alta temporalitat, jornades irregulars, rotaci\u00f3 elevada i una cultura de \u201cles hores s&#8217;ajusten sobre la marxa\u201d que fa molt dif\u00edcil demostrar el compliment quan arriba un inspector.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-1980da1 e-flex e-con-boxed e-con e-child\" data-id=\"1980da1\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-4659440 elementor-widget elementor-widget-heading\" data-id=\"4659440\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Els problemes concrets del registre horari a l'hostaleria\n<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-dc97ee5 elementor-widget elementor-widget-text-editor\" data-id=\"dc97ee5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p class=\"font-claude-response-body break-words whitespace-normal leading-[1.7]\"><strong>Torns partits i m\u00faltiples fitxatges diaris.<\/strong>  En un restaurant amb servei de dinar i sopar, un empleat pot tenir torn de mat\u00ed, descans intermedi i torn de tarda-nit. Aix\u00f2 s\u00f3n com a m\u00ednim 4 fitxatges al dia per persona. Multiplicat per una plantilla que canvia cada setmana segons les reserves, el paper i l&#8217;Excel col\u00b7lapsen.  <\/p><p class=\"font-claude-response-body break-words whitespace-normal leading-[1.7]\"><strong>Personal temporal i de refor\u00e7.<\/strong>  Els treballadors eventuals de cap de setmana, els refor\u00e7os en temporada alta i el personal extra per a esdeveniments han de registrar la jornada exactament igual que el personal fix. Una empresa d&#8217;hostaleria a Madrid va ser sancionada amb <strong>6.200 \u20ac el 2024 precisament per no incloure els fitxatges de treballadors temporals<\/strong> als seus registres. <\/p><p class=\"font-claude-response-body break-words whitespace-normal leading-[1.7]\"><strong>Les inspeccions sense av\u00eds.<\/strong>  A l&#8217;hostaleria, les visites de la Inspecci\u00f3 de Treball s\u00f3n freq\u00fcents sense previ av\u00eds, incloent caps de setmana i festius, durant el servei. L&#8217;inspector t\u00e9 dret a accedir a l&#8217;establiment, demanar la documentaci\u00f3 i entrevistar els treballadors a l&#8217;acte. Si el registre est\u00e0 en una carpeta al despatx del comptable que nom\u00e9s obre els dilluns, tens un problema.  <\/p><p class=\"font-claude-response-body break-words whitespace-normal leading-[1.7]\"><strong>Els fulls de paper no convencen.<\/strong>  Una empresa d&#8217;hostaleria a Guadalajara va ser sancionada per no registrar la jornada, cosa que va facilitar que la inspecci\u00f3 destap\u00e9s jornades de 12 a 14 hores sense compensaci\u00f3 i nocturnitat no pagada. Un altre establiment va rebre <strong>6.251 \u20ac de multa per seguir usant fulls de paper signats<\/strong> , considerats poc fiables i gens transparents. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c78f5f7 elementor-widget elementor-widget-heading\" data-id=\"c78f5f7\" Treball. Per\u00f2 el problema espec\u00edfic d&#8217;aquest sector no \u00e9s tant la manca de registre com la qualitat del que es registra. <\/p><h3 class=\"text-text-100 mt-2 -mb-1 text-base font-bold\">El problema dels contractes a temps parcial<\/h3><p class=\"font-claude-response-body break-words whitespace-normal leading-[1.7]\">El comer\u00e7 t\u00e9 una alta proporci\u00f3 de treballadors a temps parcial: caixeres, dependents de cap de setmana, refor\u00e7os de temporada. La llei t\u00e9 aqu\u00ed un parany important que molts empresaris no coneixen. <\/p><p class=\"font-claude-response-body break-words whitespace-normal leading-[1.7]\">L&#8217;article 12.4.c) de l&#8217;Estatut dels Treballadors estableix que, en contractes a temps parcial, <strong>si no es porta correctament el registre, el contracte es presumeix celebrat a jornada completa<\/strong> . \u00c9s a dir: si tens alg\u00fa contractat 20 hores setmanals i no pots demostrar amb registres fiables que nom\u00e9s ha treballat aquestes 20 hores, la inspecci\u00f3 pot presumir que has tingut aquesta persona a jornada completa sense pagar-li com a tal. Les conseq\u00fc\u00e8ncies inclouen reclamaci\u00f3 de difer\u00e8ncies salarials i cotitzacions no ingressades.  <\/p><p class=\"font-claude-response-body break-words whitespace-normal leading-[1.7]\">Un comer\u00e7 detallista a Val\u00e8ncia va rebre una <strong>multa de 3.500 \u20ac per registres incomplets<\/strong> i manca de signatura digital als informes mensuals, cosa que va invalidar tota la documentaci\u00f3 davant la inspecci\u00f3.<\/p><h3 class=\"text-text-100 mt-2 -mb-1 text-base font-bold\">Els horaris de cap de setmana i festius<\/h3><p class=\"font-claude-response-body break-words whitespace-normal leading-[1.7]\">El comer\u00e7 t\u00e9 la particularitat que molts dels seus dies de m\u00e9s activitat s\u00f3n diumenge, festius i per\u00edodes com Nadal o rebaixes. Sense un sistema de registre fiable, \u00e9s impossible acreditar ni el nombre d&#8217;hores extra ni la retribuci\u00f3.  <\/p><p class=\"font-claude-response-body break-words whitespace-normal leading-[1.7]\">A m\u00e9s, el conveni fixa una jornada m\u00e0xima de <strong>40 hores setmanals<\/strong> amb distribuci\u00f3 que respecti els descansos m\u00ednims, cosa que en obres amb pics d&#8217;activitat \u00e9s freq\u00fcentment vulnerable a irregularitats.<\/p><h3 class=\"text-text-100 mt-2 -mb-1 text-base font-bold\">El problema del treball a m\u00faltiples ubicacions<\/h3><p class=\"font-claude-response-body break-words whitespace-normal leading-[1.7]\">Un treballador de la construcci\u00f3 pot estar en tres obres diferents en una setmana. El registre horari ha de reflectir la jornada real del treballador independentment d&#8217;on estigui treballant. Molts sistemes permeten a m\u00e9s geolocalitzaci\u00f3 opcional, cosa que afegeix una capa de verificaci\u00f3 sense ser encara un requisit legal. <\/p><h3 class=\"text-text-100 mt-2 -mb-1 text-base font-bold\">Les hores extra a l&#8217;obra i el risc legal<\/h3><p class=\"font-claude-response-body break-words whitespace-normal leading-[1.7]\">La Inspecci\u00f3 de Treball travessa les dades del registre horari amb les cotitzacions a la Seguretat Social. Si detecteu hores extra que no s&#8217;han cotitzat, afegiu el rec\u00e0rrec de quotes m\u00e9s els interessos de demora. La llei no distingeix per tipus de contracte ni per durada. <\/p><p>\u00c9s precisament en aquest punt on la Inspecci\u00f3 de Treball detecta m\u00e9s irregularitats a l&#8217;hostaleria: empreses que porten b\u00e9 el registre del personal habitual per\u00f2 ometen els eventuals. La llei exigeix \u200b\u200bregistrar <strong>cada inici i cada fi de jornada<\/strong> , per la qual cosa en aquest cas serien almenys quatre fitxatges diaris per persona. <\/p><p>El temps del descans intermedi no computa com a jornada treballada, per\u00f2 ha de quedar reflectit al registre perqu\u00e8 sigui coherent: entrada, pausa, reincorporaci\u00f3 i sortida. Un registre que nom\u00e9s mostra l?hora d?entrada del mat\u00ed i la sortida de nit, sense reflectir la pausa, no \u00e9s objectivament fiable i pot ser q\u00fcestionat per l?inspector. <\/p><p>El meu registre permet configurar aquests torns amb les pauses correctes des del principi, evitant que l&#8217;empleat hagi de recordar fitxar manualment cada dia.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t<details id=\"e-n-accordion-item-1152\" class=\"e-n-accordion-item\" >\n\t\t\t\t<summary class=\"e-n-accordion-item-title\" data-accordion-index=\"3\" tabindex=\"-1\" aria-expanded=\"false\" aria-controls=\"e-n-accordion-item-1152\" >\n\t\t\t\t\t<span class='e-n-accordion-item-title-header'><h3 class=\"e-n-accordion-item-title-text\"> Qu\u00e8 passa amb els diumenges i festius treballats? El que canvia no \u00e9s el registre, sin\u00f3 el que aquest registre activa. <\/p><p>La majoria de convenis col\u00b7lectius de comer\u00e7 reconeixen un plus espec\u00edfic per treballar diumenge o festiu, i en molts casos el dret a un dia de descans compensatori. Si el registre no reflecteix amb precisi\u00f3 quins dies va treballar cada empleat, \u00e9s impossible comprovar si els plusos s&#8217;han aplicat correctament i si s&#8217;han concedit els descansos compensatoris obligatoris. <\/p><p>Quan arriba una inspecci\u00f3 o un treballador reclama, el registre horari \u00e9s l?\u00fanica font de veritat. Un sistema que diferencia clarament els dies treballats \u2014incloent-hi festius\u2014 et protegeix davant de qualsevol reclamaci\u00f3 posterior. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/details>\n\t\t\t\t\t\t<details id=\"e-n-accordion-item-1153\" class=\"e-n-accordion-item\" >\n\t\t\t\t<summary class=\"e-n-accordion-item-title\" data-accordion-index=\"4\" tabindex=\"-1\" aria-expanded=\"false\" aria-controls=\"e-n-accordion-item-1153\" >\n\t\t\t\t\t<span class='e-n-accordion-item-title-header'><h3 class=\"e-n-accordion-item-title-text\"> Durant quant de temps he de guardar els registres horaris? <\/h3><\/span>\n\t\t\t\t\t\t\t<span class='e-n-accordion-item-title-icon'>\n\t\t\t<span class='e-opened' ><i aria-hidden=\"true\" class=\"fas fa-angle-up\"><\/i><\/span>\n\t\t\t<span class='e-closed'><i aria-hidden=\"true\" class=\"fas fa-angle-down\"><\/i><\/span>\n\t\t<\/span>\n\n\t\t\t\t\t\t<\/summary>\n\t\t\t\t<div role=\"region\" aria-labelledby=\"e-n-accordion-item-1153\" class=\"elementor-element elementor-element-c80bf0f e-flex e-con-boxed e-con e-child\" data-id=\"c80bf0f\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-7ff3ca1 elementor-widget elementor-widget-text-editor\" data-id=\"7ff3ca1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>4 anys.<\/strong>  L&#8217;article 34.9 de l&#8217;Estatut dels Treballadors estableix que els registres de jornada s&#8217;han de conservar durant quatre anys i han de romandre a disposici\u00f3 dels treballadors, els seus representants legals i la Inspecci\u00f3 de Treball.<\/p><p>Aix\u00f2 significa que avui, al mar\u00e7 del 2026, has de tenir disponibles els registres des del mar\u00e7 del 2022. Una empresa de comer\u00e7 va ser sancionada amb <strong>3.126 \u20ac<\/strong> precisament per haver eliminat els registres despr\u00e9s d&#8217;un mes, al\u00b7legant que ocupaven massa espai. <\/p><p>Amb un sistema digital al n\u00favol, els registres es conserven autom\u00e0ticament durant el per\u00edode legal sense que hagis de fer res. Un encarregat que anota les hores de tota la quadrilla al final del dia \u2014encara que ho faci de bona fe\u2014 est\u00e0 generant un registre estimat, no real, i aix\u00f2 ho invalida davant d&#8217;una inspecci\u00f3. <\/p><p>A m\u00e9s, quan l&#8217;encarregat registra pels altres, es perd un dels elements clau que fa fiable el sistema: que \u00e9s el mateix treballador qui acredita la jornada. Si un treballador despr\u00e9s al\u00b7lega que va treballar m\u00e9s hores de les registrades, un sistema en qu\u00e8 l&#8217;encarregat fitxava per ell no t\u00e9 cap validesa probat\u00f2ria a favor de l&#8217;empresa. <\/p><p>La soluci\u00f3 correcta \u00e9s que cada operari tingui acc\u00e9s al seu propi sistema de fitxatge, encara que sigui des del m\u00f2bil, i que el registre passi en el moment real d&#8217;inici i fi de la jornada.<\/p><p>Un sistema on una persona fitxa per altres \u00e9s, a la pr\u00e0ctica, tan inv\u00e0lid com no tenir registre.
